Puppy Contract
1.The Buyer must have the puppy examined by a licensed DVM (Doctor of Veterinary Medicine) within two (2) days of receipt of the puppy excluding weekends and holidays. The Seller must be informed within twenty-four (24) hours of the examination's result by e-mail. The email needs to include a summary of the vet visit, the date, time, and vet’s name and phone number. Failure to comply will render this guarantee void.
*If puppy is found to be medically deficient with an untreatable or life-threatening problem, it must be reported immediately to the Seller. Upon the puppy's return, it will be replaced with another puppy of equal or comparable value, when one is available. This health concern must be verified in writing by licensed vet and within the 24 hour time period, and cannot have been exposed to ANY other dogs during this time. The attending veterinarian may email Seller anytime at sgashepherds@hotmail.com
*If no comparable puppy is available at time of return, Seller has 12 months to furnish a replacement puppy or refund purchase price. (Seller-Breeder's choice) Purchase price does NOT include shipping cost. It is only the price of the animal. Shipping on a replacement puppy will be paid by Buyer.
*If veterinarian care is ignored or not applied as prescribed Buyer forfeits all claims to a replacement animal, or refund, or reimbursement of medicines.
*If the puppy dies within the guarantee period, despite medical treatment, compensation (puppy only ) will be made ONLY if a licensed Veterinarian certifies the cause of death is not due to the Buyer's negligence and was a direct result of a communicable disease.
2. The Buyer agrees that any and all transportation costs, to and/or from the Seller's premises, will be at the cost and sole responsibility of the Buyer.
3. Your puppy is currently eating Iams Proactive Health Smart Puppy Large Breed. Even if you plan to switch brands we highly recommend ordering at least a small bag of food as making an abrupt change in a puppy’s food can cause digestive problems. Having a small bag on hand will help to make the transition as easy as possible. We recommend letting the puppy settle into your routine before switching. To switch to your own preference of dog food make the change a gradual process to help the puppy adjust, usually over a 7 – 10 day period, slowly increasing the ratio of food you prefer. Most dog food brands have their own recommendations on how to switch a dog over to their food. You should follow any directions printed on their bag. . We advise purchasing a quality puppy feed with real meats instead of by products as the first or main ingredient.
4. One Year Guarantee: If within one (1) year from the date of birth, a dog is found and certified by two (2) different licensed DVM's to have congenital or hereditary disorders which adversely affect the health of the animal or is life-threatening, or in the unlikely event of the death of the puppy, and if Seller is notified within two (2) business days of the veterinarian's determination, the Seller will credit 100% of the original purchase price toward a replacement puppy. All conditions set forth in paragraph 14 shall apply.
5. If the Buyer declines the replacement puppy, then the Seller shall be under no further obligation and it will be deemed that the Buyer has released the Seller from all further claims.
6. Temperament issues are not covered under this guarantee as they can be caused by a lack of training, discipline or proper socialization. All puppies are sold as pets; no guarantee is made as to disposition, conformation, size, weight, color, markings or breeding ability. Seller sells pets for companion purposes only.
7. The Buyer agrees that if more than one puppy is purchased, then at least one of the puppies will be spayed or neutered. The Buyer agrees that puppies are sold for pet purposes only, not for breeding purposes. The buyer will assume all costs associated with spaying/neutering.
8. The value of the puppy for the purpose of this guarantee is solely the original purchase price of the puppy, and does not include shipping costs, health certificate, shipping crate or any additional prices declared by the Seller.
9. Registration papers for all registered puppies will either be sent with the puppy at time of delivery or will be sent by regular mail which could take up to two weeks. If the papers are lost, the Seller will assist the Buyer in obtaining new papers at the Buyer's expense. In the event this guarantee is exercised, the registration papers must be returned to the Seller.
10. An administrative fee of $250.00 shall be retained by the Seller should the Buyer decide to cancel any time prior to shipping. If Buyer should cancel within 48 hours of the “Delivery Date” listed above the amount listed above as the “Transportation Cost” will also be retained by the Seller. These fees are to reimburse the Seller for out-of-pocket expenses and overhead costs associated with the transaction.
11. The Seller disclaims any and all implied warranties of merchantability and fitness. Puppy will leave our care current on all age appropriate vaccinations and dewormings. A complete medical record will accompany your puppy.
12. The seller will not accept any returns of said puppy for any monetary refund, including but not limited to allergy, Landlord/Tenant, marital, or adjustment problems, etc. If Buyer must return puppy for any reason, it will be on a surrender basis only with no refund or credit.
13. Limitations of Guarantee: The dog must be in good physical condition. In the unlikely event said puppy is found to have a congenital or genetic defect that is life-threatening, a statement from two (2) different licensed DVM's one of Buyer's choosing and one of Seller's choosing to determine the Congenital defect at the Buyers cost. If this guarantee is exercised and a replacement puppy is given then the original puppy must be returned to the Breeder unless agreed upon in writing. All shipping costs are paid by the Buyer. No replacement will be given if the female has been bred. All laboratory verification must be done by a licensed DVM. No replacement will be given if breeds that are known to be prone to hip dysplasia are overweight or over exercised. The Buyer is responsible for the daily health care and maintenance of the pet, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow-up treatments from veterinarian visits. In order for the guarantee to remain in effect you must keep receipts and records to verify that you have regularly taken your pet to a licensed veterinarian for checkups and all required immunizations. This guarantee does not cover any Veterinarian costs. The Buyer is aware that owning a puppy means frequent visits to a Licensed Veterinarian and understands that he/she will be responsible for all payments. Seller does not guarantee against low-blood sugar (Hypoglycemia), or any other non-life threatening illnesses common to puppies. This guarantee does not cover any of the following conditions: intestinal parasites (ie Coccidiosis, Giardia, Tapeworms, Hookworms, Roundworms) Kennel Cough, Skin and Ear Mites, Cherry Eye, Allergies, and Inguinal, Perineal, or Diaphragmatic Herniation, Heart Murmur grades I, II or III, Patella Luxation grades I, II or III., Serious illness and genetic life altering defects do NOT include umbilical hernia, external or internal parasites or bacteria, coccidiosis, campy giardia, diarrhea, undescended testicles, inverted vulva, allergies, cherry eye, under bite or over bite. The preceding list of illnesses and defects are not an exhaustive list .This guarantee does not cover any Veterinarian costs associated with spaying or neutering, including undescended testes. Seller reserves the right to refuse replacement of any puppy returned that may have been cause by owner abuse or negligence. Any puppy that is abused and/or neglected in the following manner (but not limited to these descriptions) may be refused a replacement puppy: kept overweight, confined to extreme cold or heat, required to perform extreme physical activities such as excessive use of stairs, running, jogging, agility jumps, or weight pulling during their 'growth period', children have been allowed to ride/jump/play on dogs back or legs. Also a dog not socialized, beaten and/or tortured may develop problems. All of these are "man-made" problems which are not caused by a hereditary defect are not the Sellers responsibility. Seller reserves the right to examine any questionable conditions pertaining to said puppies health and welfare at the Buyers expense.
14. All the above mentioned conditions must be met or all guarantees above mentioned will be void. The buyer is responsible for all transportation costs to and from the Seller. The Seller is not responsible for any veterinarian fees, shipping costs or any other associated costs.
15. South Georgia Shepherds reserves the right to have the puppy examined by a licensed veterinarian of their choice at the expense of the buyer. Should there be a discrepancy between the buyer’s and South Georgia Shepherds’ licensed veterinarian’s findings, South Georgia Shepherds’ veterinary findings shall control.
16. This agreement represents the total agreement between the Seller and the Buyer and no other terms or conditions shall be valid to this sale. The Buyer has read this agreement and agrees to the terms and conditions herein.
17. A facsimile, scanned, electronic, or copy of original signature shall be enforceable as an original if the original contract is lost, destroyed, or otherwise unavailable.
18. This Agreement is made and signed by both parties to insure the well being and protection of this animal. If any part of this Agreement is breached, the Seller is released from any further obligations hereunder. Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court fees.
*This contract is legal and binding to all parties involved. It applies ONLY the Buyer and Seller in this original transaction and is NOT transferable to other parties.
I, the purchaser of a puppy from South Georgia German Shepherds, hereby acknowledge that I have received a copy of this document. I accept the terms and conditions of the guarantee for congenital or hereditary disorders printed in this document, and I waive and relinquish any other rights that I might otherwise have in the event of such occurrence. This agreement represents the total agreement between South Georgia Shepherds and the buyer and no other terms or conditions shall be valid to this sale.
